5. What is arbitration?
It is a process of dispute resolution in which a neutral third
party (arbitrator) provides a decision after a hearing at
which both parties have an opportunity to be heard. It is
an arrangement for taking and abiding by the judgment of a
judge or attorney over some disputed matter, instead of carrying
it to established tribunals of justice, and is intended to
avoid the formalities, the delay, the expense and vexation
of ordinary litigation. Where arbitration is binding, the
disputing parties select the arbitrator who has the power
to provide a final decision. Where it is voluntary, the disputing
parties may abide by the decision or not as they see fit.

asks oral questions of the other party or of witness for the
other party. The person who is deposed is called the deponent.
The deposition is conducted under oath outside of the courtroom,
usually in one of the lawyer’s offices. A transcript
– word for word account – is made of the deposition.
